    DEAR MR. CRIPE,
    On January 22, 2015, my then 17-year old daughter was in a car accident involving an Insured Member of Allstate. My daughter and I have State Farm insurance coverage. The Allstate-insured member was determined at fault for the accident, according to the police officer on scene, as well as the 4-page Florida Traffic Crash Report (included in this correspondence). The Allstate-insured party was also issued a Florida Uniform Traffic Citation for the accident (which is also included). Our Allstate-assigned adjuster is Meagan Cuna.

    I authorized Ms. Cuna to get a statement from my 17-year old daughter relating to the accident. Ms. Cuna has yet to secure a statement from the Allstate-insured party. The vehicle in question is my XXXXXXXX, which was inspected by Allstate and determined to be a total loss on 1/26/15. At that time, the inspector advised me via phone to go to the facility where the vehicle had been towed and sign a release form, which I did on 1/26/15 (proof of release included).

    To this date, I have received no further action from Allstate and when I inquired today, 2/13/15, Ms. Cuna indicated she had not received a statement from her driver, but at any rate, me and my insurance company would probably be determined to be 50% responsible due to culpable negligence, based solely on a statement that my daughter made, “I never saw the other car coming.” I would say that is a standard 17-year old’s response to an accident that she was shaken up by.

    At any rate, I do not understand how a company can take a stand or position that they are not going to be 100% responsible, based on the facts, proof, and evidence in the case. In the 4-page police traffic report, it was stated multiple times that my daughter was not at fault or negligent in any way. Why do legal documents not take precedence over a minor’s flippant comment that “she never saw the other car coming”? I would think, naively, that is in fact how an “accident” occurs – because we don’t have crystal balls or 20-20 hindsight vision.

    I am disgusted and disheartened by the lack of activity your company and your company’s representatives are taking. My damaged vehicle has a value of $6,700; not $50,000. Right is right, and wrong is wrong. People make mistakes and accidents happen, but it is up to insurance companies to make things right – especially when their party is clearly at fault. Also, I have not been contacted about any arrangements for a rental car from your company, so my daughter and I have been inconvenienced to carpool with family members for the past 3 weeks.

    Something that was not mentioned in the crash report, although I do not know why, is not only did the guilty party fail to yield right of way, the party was making an illegal maneuver: going straight out of a parking lot, crossing 2 double, solid, yellow lines of a roadway, to cross straight forward to another shopping store parking lot. Not only is it illegal by Florida Highway Laws to cross a double, solid, yellow line; but there is a right turn only arrow painted on the ground coming out of the parking lot that the guilty party was exiting. So, again, explain to me how my daughter was 50% negligent and responsible?

    I would like this matter to be looked into, and I will continue to write and call whoever within your firm I may need to for this to be properly addressed and handled. As of now, I can assure you, with this type of treatment, neither I or any family member of mine will ever be a customer of Allstate; because, in total opposite terms of your commercials, one is NOT “in good hands with Allstate.” Well, perhaps your insured member is in this case since your company has stalled and dragged their feet and has allowed the responsible party to ignore phone calls related to this matter since the accident occurred.

    This is how your representatives are conducting business on your behalf. As an educated college counselor, I would personally be embarrassed if I were in your shoes.
